I was served with notice that I was being sued on the same day I learned that my first born son had passed away. I did not know what to do. Overall, I feel Michelle is not always forth coming with matters concerning my case. On April 24th, I emailed her to get a follow-up on the conversation we had on February 26th. A phone call that I initiated. During our conversation, she said it was the deadline for all my creditors to contact her. She also said that she would remove a creditor from the bankruptcy and that my trustee payments would decrease. Two months later, when I still hadn't heard from her, I emailed her on April 24th. By May 1st, I hadn't heard from her so I sent a follow up text. The next day her response was, "I was on vacation. Yes, I've received email...I can't do anything about your mortgage...I have insurance broker if you need one" That was it. None of the questions I asked were answered, and the statements about my mortgage were a repeat of what I had already stated in my email. My biggest concerns were ignored. I requested a phone conference with her so that my concerns could be addressed. Instead of a phone conference she emailed me. On May 4th I received an email From Michelle of the amended plan. After I contacted her, and insisted on speaking with her. The plan should have been amended before then I believe. However, when I got the Amended Plan document in the mail, it reflected 5 payments to the trustee and not the 6 that I actually made. The last payment cleared on May 7th. Michelle had record of this payment and the other four made on the TFS website. She had no record of my initial payment made by check on January 2nd. When I brought this error to her attention on May 11th, her response was, "I have to go hy what is on tfs system on date I amend plan. If a payment is lost you need to trace it and provide proof deposited and then it will apply going forward." Why am I responsible for correcting an error made by my attorney? She deals with the assessor's office frequently. Why couldn't she contact them? The women I spoke to at the assessor's office even asked me why I was calling and not my lawyer. Thanks to the paralegal, and auditor, the situation was cleared up. But overall, unless I speak up, and ask questions, the person getting paid to represent me, Michelle, seems very lackadaisical in responding to my concerns.
