I was involved in a divorce case where litigation strategy prioritized procedural wins over economic outcomes. In January 2025, the marital home was valued at $370,000, and a negotiated buyout at fair market value was on the table. Instead, the matter proceeded toward an open-market sale. The home ultimately sold for $285,000, and after transaction costs and mortgage payoff, the net proceeds were dramatically lower than what would have been achievable through negotiation.Plus all the heartache of trial. What do they "fight 4"? Not money for their clients, apparently. The case left me questioning whether clients are always being guided toward strategies that maximize their financial outcomes, versus strategies that simply prevail in court. Future clients may want to ask detailed questions about cost-benefit analysis before pursuing prolonged litigation.
