Hinzman & Flory

Kevin Hinzman withdrew from my case after I asked him to provide his highly questionable legal advice in writing. After I filed a bar complaint, Kevin Hinzman and Craig Flory retaliated by asking the prosecutor to do a State's motion for mental incompetency. Their misconduct delayed my case for months, and subjected me to an unnecessary and invasive examination. Based on the totality of my interactions with this firm, I believe these attorneys engage in a pattern of colluding with prosecutors and preying upon vulnerable, mentally ill defendants through Denton County's indigent defense program. I was assigned Kevin Hinzman as a court-appointed attorney in Denton County in March, 2025, for an Interference with Public Duties charge stemming from an incident where I was arrested after calling 911 for my mother's health emergency. After being restrained by 3 multiple officers, the arresting officer used a leg trip takedown and punched me repeatedly while I was restrained on the ground. He could be seen on body camera footage asking his colleague, "what should I charge him with?" after the arrest. During an in-person consultation on March 25, Hinzman played some of this body camera footage and said "don't the police have a hard job?" Hinzman repeatedly asked if I would be willing to enter a guilty plea, but was not able to articulate how I had broken the relevant law. Specifically, he was unable to articulate how my actions- attempting to see my mother during a health emergency- satisfied the criteria for criminal negligence, the required mental state for my charge, which requires a "gross deviation" from a reasonable person's standard of care. He also brought up several potential conflicts of interest, such as his son entering a career in law enforcement, but never formally described them as such or asked me to sign any waiver. When I asked Hinzman to put his questionable legal advice in writing, he immediately withdrew from my case citing "conflicts" and "veiled threats to [his] professional responsibility." (PIC-1) When pressed on how exactly requesting his legal position in writing was a "veiled threat," Hinzman did not answer. (PIC-2) On April 8, I filed a grievance with the State Bar of Texas regarding this conduct. (PIC-3) I was especially concerned that Hinzman informed me that he represented "a lot of mentally ill" defendants through the County's indigent defense program. Given the unscrupulous practices I had experienced- immediately pressuring me to enter a guilty plea, refusing to put legal positions in writing- I was concerned that vulnerable defendants would be preyed upon. On July 28, 2025, the prosecutor assigned to my case, Cecilia Weigel, raised the issue of mental competency to stand trial during a status hearing. She said, "I've spoken to Craig Flory and Kevin Hinzman, who were his previous attorneys, and they have urged me to do a State's motion for competency" (PIC-4). At this point, I had not spoken with Hinzman or Flory in nearly 4 months. The last communication was on April 1, where we communicated regarding my request for my case file. The only notes from the case file which Hinzman described as containing "everything in your physical file as well as our digital file" (PIC-5) did not mention any concerns related to mental competency. In fact, the only mention of mental health issues was "Clean, no alcohol or drugs" (PIC-6). In other words, there was no documented concern regarding incompetency, and no contact between myself and Hinzman for 4 months. In apparent retaliation for my bar complaint, Hinzman and Flory asked the prosecutor to raise the issue of mental incompetency to stand trial in my case- forcing me to endure an invasive and unnecessary examination, and stalling my case for months. On December 29, 2025, I wrote to Hinzman, attaching an excerpt of the court transcript and asking him to confirm if he had asked the prosecutor to raise the issue of competency. I have not received any reply. If I do receive a reply, I will update the review. Be extremely wary of these individuals.

Well Mr. Flory and I did not hit it off on the right foot very well. Regardless of the reasoning, we were able to put our differences aside and he pulled through for me in a pretty incredible way! He was able to get my felony charge reduced to a misdemeanor and a 500 fine, which I couldn't be any more greatful for. Thank you Mr. Flory, you are a GREAT lawyer 🙂
