After a 2-1/2 year arbitration and over $75k spent on legal fees, my attorney, Justin DePaul, informed me that the judgment that I was awarded was uncollectible because of a "rookie mistake" (his own words). He failed to add the spouse’s name to the arbitration so community property could be collected on to pay the judgment. Justin knew my ex-business partner was unethical and a scoundrel, which is why I removed myself as a partner from the business and there was a need for arbitration in the first place, so by making this "rookie mistake" it allowed any assets that could have been collected, easily transferred to the spouse who was not named and hide assets, essentially in plain sight. During the time of filing the arbitration application, I emailed Justin regarding the spouse’s unethical behavior and an active arrest warrant in another state, with the spouse’s name in the subject line, and Justin still failed to recognize his "rookie mistake". Justin provided me with three options to try and remedy his "rookie mistake" and add the spouse’s name, after the fact, and by his own admission were not likely to result in success. Most likely, this memo, was a way for him to cover his tracks in case I brought a legal malpractice claim against him. This memo would serve two purposes. It would prove he had disclosed his "rookie mistake" and the consequences that would come from it, and it would also serve as a potential defense against a legal malpractice claim. I am also extremely confident that Justin did not find this "rookie mistake" on his own. Justin had referred the collection of the judgment to another attorney at the firm and upon emailing with the attorney who was going to be helping me with collections, I emailed the attorney with properties I found on a county accessor’s website that were titled in community property with both spouses names, so we could ensure we filed the judgment in that county too. The next day, I received a call from Justin informing me of his "rookie mistake". If I had not provided this property information to the other attorney, I would have begun spending even more money on a seemingly uncollectible judgment. His "rookie mistake" did not cost him or my ex-business partner. It cost me.
